Property Listing Agreement

Our Terms.

Terms and conditions governing the listing of commercial properties with M/s Sachdeva Estates, Mohali. Please read carefully before submitting your property details.

Key Commercial Term

Brokerage: 2 months’ equivalent of the agreed monthly rent, payable upon successful lease execution.

GST applicable over and above. Payable within 7 working days of lease signing.

1. Scope of Engagement

By submitting your property details through our listing form or by entering into a verbal or written mandate arrangement with M/s Sachdeva Estates (“we”, “us”, “the firm”), you (“the Owner”, “the Client”) agree to the terms set out on this page.

These terms govern the relationship between the property owner and Sachdeva Estates in connection with the leasing, sub-leasing, or licensing of commercial property (retail spaces, office spaces, standalone buildings, SCOs, warehouses, and other commercial real estate assets) in Chandigarh Tricity and surrounding areas.

2. Brokerage / Professional Fee

Sachdeva Estates charges a professional brokerage fee equivalent to two (2) months’ rent of the agreed monthly lease value, payable by the property owner upon successful execution of a lease deed, leave & licence agreement, or any other tenancy agreement between the owner and the tenant introduced by Sachdeva Estates.

  • The brokerage is calculated on the base monthly rent agreed at the time of lease execution, excluding any CAM charges, maintenance fees, or escalations.
  • The fee is due and payable within seven (7) working days of the execution of the lease agreement or receipt of the security deposit from the tenant, whichever is earlier.
  • In case of a lease renewal at the end of the initial term, a fresh brokerage will apply at the same rate, unless a separate written agreement has been executed.
  • GST at the applicable rate is payable on the brokerage amount, over and above the brokerage fee.

3. Mandate Duration

Unless otherwise agreed in writing, the mandate granted by the owner to Sachdeva Estates shall be valid for a period of six (6) months from the date of the property submission or mandate signing. Upon mutual agreement, the mandate may be extended for a further period. Sachdeva Estates reserves the right to decline or withdraw from any mandate at its sole discretion, without liability.

4. Exclusivity

Where an exclusive mandate has been agreed upon (verbally or in writing), the owner agrees not to independently lease the property or engage any other broker, agent, or intermediary for the duration of the mandate period without prior written consent from Sachdeva Estates.

If the property is leased during the exclusive mandate period — directly by the owner or through any other channel — the agreed brokerage fee shall still be payable in full to Sachdeva Estates, as the introduction of the leasing opportunity was made possible through our advisory engagement.

5. Owner Obligations

  • Provide accurate, complete, and up-to-date information regarding the property, including area, legal status, encumbrances, and ownership documents.
  • Make the property available for inspection and site visits upon reasonable notice, and cooperate with the firm in facilitating visits for prospective tenants.
  • Disclose any existing tenancy, legal dispute, mortgage, charge, or other encumbrance on the property before or at the time of listing.
  • Notify Sachdeva Estates immediately if the property is leased through any other channel during the mandate period.
  • Provide all necessary documents (title deed, identity proof, NOC if applicable) required by the prospective tenant or their legal counsel.

6. Sachdeva Estates Obligations

  • Make reasonable best efforts to source qualified, creditworthy tenants for the listed property.
  • Maintain confidentiality of all property details and not disclose them to any party without the owner's consent.
  • Present the property professionally to prospective tenants and manage initial discussions.
  • Provide honest advisory on market-appropriate rent, lease terms, and tenant suitability.
  • Sachdeva Estates does not guarantee the successful execution of any lease or tenancy agreement.

7. Confidentiality

All property details, financial information, ownership documents, and personal information shared with Sachdeva Estates in connection with a listing or mandate shall be treated as strictly confidential. Such information will not be disclosed to any third party without the express written consent of the owner, except where required by law or by a court of competent jurisdiction. Prospective tenants will only receive property information that has been expressly approved for sharing by the owner.

8. Limitation of Liability

Sachdeva Estates shall not be held liable for any loss, damage, or expense arising from the failure to secure a tenant, the conduct of any prospective tenant introduced by the firm, or from inaccurate information provided by the owner. The firm acts as a facilitator and intermediary and is not a party to the lease agreement between the owner and the tenant.

9. Amendments

Sachdeva Estates reserves the right to revise these terms at any time. The updated terms will be published on this page with a revised effective date. Continued engagement with the firm after any revision constitutes acceptance of the updated terms.

10. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these terms, or any mandate or engagement between the owner and Sachdeva Estates, shall be subject to the exclusive jurisdiction of the courts at Mohali, Punjab.
